Katy Miller Creates Environment to Resolve Employment Dispute

Mediator Katy Miller helped a company return to work a long-term employee who had been terminated while on medical leave. She not only returned to work, but returned comfortably to a warm welcome from her managers and co-workers.

The problem started when new managers came into the company while the long-time employee was on medical leave for a critical illness, and terminated her when all of her leave time, including her FMLA leave, expired. She threatened to file a claim under the ADA and sue for wrongful termination. Before the claim was filed, the parties agreed to try mediation and called Katy Miller, whose reputation for successful dispute resolution was well known to them.

During the challenging one-day mediation, Katy facilitated open conversation between the parties. The employee expressed how she felt abandoned when she was laid off, but she liked working at the company and wanted to return. The employer realized the employee's value to the company, apologized to the employee for what she had been through, and not only reinstated her, but promoted her.

At the end of the day, the tearful parties signed a settlement agreement, hugged and left the mediation happy - the employee feeling valued and relieved to stay with the company she loved, the employer grateful to keep an important employee and resolve the dispute without litigation.
